Terms of Use

1. Agreement

Zenelia is a product of Avasy Inc., a federally incorporated company in Ontario, Canada (Corporation Number: 924562-6), referred to here as "we" or "us". These Terms apply to the Zenelia app and our websites, including zenelia.ai and zenelia.com. By creating an account, making a purchase, or using Zenelia, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Zenelia.

2. Not Medical Advice

Zenelia is a brain training app for general wellness. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or condition, including dementia or Alzheimer's disease. Zenelia's exercises are inspired by published cognitive training research, but Zenelia itself has not been tested in those studies, and your results may vary.

Game scores reflect how you performed in the app's games. They naturally vary with sleep, mood, difficulty, and practice, and they are not a medical or cognitive assessment. Monthly training reports summarize your activity and scores only.

The AI coach offers general training guidance, can make mistakes, and does not give medical advice. If you have concerns about your memory, thinking, or health, please talk to a qualified healthcare professional. If you are in crisis or at risk of harm, contact local emergency services right away (in the US and Canada, call or text 988).

3. Your Account

You must be at least 13 years old to use Zenelia. If you are under 18, or under the age of majority where you live, please use Zenelia with a parent or guardian's permission. Keep your login details secure; you are responsible for activity on your account. Please give accurate information when you sign up.

4. Subscriptions and Free Trials

Premium subscriptions (monthly or yearly) are sold through Apple's App Store and billed to your Apple ID in your local currency, at the price shown in the app. A subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel it anytime in Settings → Apple ID → Subscriptions.

A free trial becomes a paid subscription when it ends unless you cancel at least 24 hours before the trial ends. Refunds for App Store purchases are handled by Apple under Apple's policies, which you can request at reportaproblem.apple.com.

5. Lifetime Access

Lifetime access is a one-time purchase with no renewals. "Lifetime" means for as long as Zenelia is offered by us or by a company we transfer it to (see Section 8). It does not mean the lifetime of any person. Lifetime access includes the Premium features available at any given time, which may change as described in Section 7.

Gift codes can be redeemed once, on one account, and have no cash value.

6. Gifts Bought on Our Website

Gifts bought on our website are processed securely by Stripe, charged in the currency shown at checkout, and delivered to the recipient as a gift code by email. If a gift code has not been redeemed, you can ask for a refund within 30 days of purchase by emailing hello@zenelia.ai. Redeemed codes are not refundable, except where the law requires otherwise.

7. Changes to Zenelia and Discontinuation

We're always improving Zenelia, so we may add, change, or remove games and features. We may also decide to stop offering Zenelia. If we do, we will give you at least 60 days' notice in the app or by email, and you will be able to export your data before the service closes.

When Zenelia stops being offered, all subscriptions and lifetime access end. We will stop charging for new subscription periods. Nothing in these Terms limits any refund you are entitled to under applicable consumer protection law.

8. Transfer of the Service

We may transfer Zenelia, your account, and these Terms to another company, for example if Zenelia is sold or moved to an affiliated company. If that happens, your subscription or lifetime access continues with the new operator under these Terms.

9. Acceptable Use

Please don't misuse Zenelia. That includes trying to hack, reverse engineer, overload, or copy the app or its content; using it for anything illegal; sharing your account to get around limits; or abusing the AI coach. We may suspend or close accounts that break these rules.

10. Your Data

Our Privacy Policy explains what we collect and how we use it, including how the AI coach processes your data. You can export your data or delete your account at any time from within the app.

11. Intellectual Property

Zenelia, its games, content, design, and the Zenelia name belong to Avasy Inc. We give you a personal, non-transferable licence to use Zenelia for your own non-commercial use while these Terms apply.

12. Disclaimers

Zenelia is provided "as is" and "as available". We work hard to keep it running well, but we don't promise it will always be available, error-free, or that it will produce any particular result.

13. Limitation of Liability

To the extent the law allows, Avasy Inc. is not liable for indirect, incidental, special, or consequential damages arising from your use of Zenelia. Our total liability for any claim is limited to the amount you paid us for Zenelia in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you, and nothing here limits rights you have that cannot be waived under consumer protection law.

14. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and disputes will be handled by the courts of Ontario. If you are a consumer, you also keep any protections given to you by the laws where you live.

15. App Store Terms

If you downloaded Zenelia from Apple's App Store: these Terms are between you and Avasy Inc., not Apple, and Avasy Inc. is responsible for Zenelia and its content. Apple has no obligation to provide maintenance or support for Zenelia. If Zenelia fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation. Apple is not responsible for any product claims relating to Zenelia, or for investigating or defending any claim that Zenelia infringes someone else's intellectual property. You confirm that you are not located in a country subject to a Canadian or U.S. government embargo and are not on any government list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and let you know in the app or by email. If you keep using Zenelia after changes take effect, you accept the updated Terms.
